1. Fiduciary Duties (OLD CAR)
The legal obligation of an agent to act in the best interest of their principal. Remember the acronym OLD CAR: Obedience, Loyalty, Disclosure, Confidentiality, Accounting, and Reasonable Care.
2. Adverse Possession
A legal principle where someone can claim ownership of land by occupying it openly and continuously for a specific period (5 years in California) and paying property taxes.
4. Functional Obsolescence
A reduction in a property’s value due to an outdated feature or poor design (e.g., a 4-bedroom house with only one bathroom). This is different from physical wear and tear.
4. Encumbrance
Any claim, lien, or liability attached to a property that may lessen its value, such as a mortgage or an easement, but does not necessarily prevent transfer of title.
5. Steering & Redlining
Steering: Channeling buyers toward or away from neighborhoods based on race. Redlining: Lenders refusing loans in certain areas based on protected characteristics. Both are illegal under Fair Housing laws.
6. Fee Simple Defeasible
Ownership that can be taken away if a specific condition is violated (e.g., “The property must be used only as a park”).
7. Net Operating Income (NOI)
Calculated as Gross Income minus Operating Expenses. Note: Mortgage payments (debt service) are not included in NOI.
8. Littoral vs. Riparian Rights
Littoral: Rights for land bordering a lake or ocean. Riparian: Rights for land bordering a flowing river or stream.
9. Bilateral vs. Unilateral Contract
Bilateral: A promise for a promise (e.g., a standard purchase agreement). Unilateral: A promise for an act (e.g., an option contract or a reward poster).
10. The Bundle of Rights
The legal rights that come with property ownership, often compared to a “bundle of sticks.” These include the rights of Possession, Control, Enjoyment, Exclusion, and Disposition.
